eviction of tenants

My husband and I have rented out our basement on a month to month rental agreement, in November we gave our tenent 60 days notice to vacate which ment she should have vacated the premesis at the end of Dec. It is now the Middle of January and She still hasen't vacated the premisis. We issued her with a final notice to vacate by the End of January. If she still refuses to vacate are we allowed to change the locks? There was only a verbal month to month agreement when she moved in What are our rights to get her out of our home?

You need to file for a Writ of Possession at the District Magistrate. The office staff will give you the correct form.

Before that hand and post a notice to quit that advises your tenant they have 10 days to leave or you will sue for a Writ of Possession. Then after the 10 days go to the District Magistrate and file suit.

It will take some time but without a writ of possession or an action in ejectment you will be undertaking a self help eviction which is a bad thing. How bad is it you may be sued for punitive damages.
