Legal Question in Landlord & Tenant Law in Pennsylvania
Our landlord issuing us for back rent. We are appealing this decision of the Magistrate but my question is, can the landlord lawfully collect rent when the building in question does not have an occupancy permjty? He has been issued 2 warnings about this from the code enforcement officer in our township. The magistrate would not hear anything about it because we did not file a counterclaim.

Once the landlord files his complaint in the Common Pleas Court you can file a counterclaim.
