Legal Question in Landlord & Tenant Law in Pennsylvania
My landlord served me with a 10 day notice to quit order but I am not even 1 full months rent behind. Is this legal? He has last months rent, can I use this money for January's rent? If not why?

Because that's probably you damage deposit. So if he allowed you to use it for rent what would he use to repair the damage after you leave. So you don't want to leave up to your duty to pay rent and now you want the landlord to give up his security deposit. What happens next month?
You don't have to be a month late with the rent. Once your pass the grace period he can start evicting you.
The rule is you pay you stay.
