Legal Question in Landlord & Tenant Law in Pennsylvania

I live in PA, and moved out of my house on May 31st, 2015. In early April of this year we noticed that raw sewage was leaking into the basement. We immediately notified our landlord of this. He hired a plumber to look at it, but did not fix the issue, instead letting it exacerbate for the next month and a half. He said it was our fault, because of flushed tampons (which none of us did). We called the plumber he hired and they sent over a faxed statement saying that the burst pipe was old and no fault of anyone, especially the tenants. On the itemized list of damages he sent us on June 30th, he did not mention the plumbing at all. We took him to small claims court and won back our security deposit on July 28th (he refused to give it back to us). A week ago, he called my roommate and said he was planning on suing us for $12,000 for the plumbing issue. We have been out of the house for 2.5 months, and though he was made aware of this issue in April he never fixed it, nor did he include it on the list of damages he sent. Can he legally sue us for this?

Well there once was a 47 year man who once sued the Redskins because they wouldn't give him a tryout. he didn't win. So in Pennsylvania he can sue you. however, given the fax you have his not going to win as long as you get someone from the company that sent the fax to say it's their fax and they actually sent it.

Good Luck,

{John}
