Moved out because of Sexual Harassment & Assault by neighbor

We were due to sign a new lease

starting November 1st, the landlord

sent an email asking us we if were

renewing for another year and that

he would work on the lease and we

could get together to sign it, the

lease officially ended October 31st.

About a week later a neighbor tried

to touch me and made a sexual

comment. Landlord did nothing

about it.

Landlord is now saying since we

didn't give 60 days notice no money

is due back to us (he got 1st, last and

security when we moved in 2 yrs

ago) We had paid November's rent

and moved the 15th and had the

place totally clean by the 20th with

keys returned (when he finally

responded to me) by the 30th. He

said if he can rent within 60 days of

us moving he will return money to

us, we feel with the situation as it

was we should be getting our money

back as we were in an unsafe

situation, as the neighbor was

constantly stalking me and would

come out and try to approach me

when I was outside. We

wrote to tell the landlord we would be

moving and they didn't respond but 2

hours later saw our apartment listed

on craigslist, so knew they accepted.

The landlord has no duty to protect you from the neighbor's improper advances. Besides it has nothing to do with your landlord.

It would be hard to say what your entitled to without seeing the lease. The question is did the lease automatically renew or not.
