moving from rental

we purchased a home and can be all moved out before the end of the month. I asked our landlord is we could give a shorter notice and not pay a full month rent. She said no. now she is saying she has a tenent who wants to move in earlier then the end of the month. I told her sorry they had to wait til jan 1st unless they want to pay me the share of the rent i paid til the end of the month.. she stated well if i have vacated prior to the end of the month she can allow them to move in as the place will be abandoned. this does not seem fair to me. is this legal. can she do this... i do not plan to turn the keys in til the 31st and the power is not set to be taken out of my name til that time.

Your situation is an example of a landlord reaping what he has sowed. If the landlord will not refund you a portion of the month that you will be gone. Then you have possession until the end of the month. Inform the landlord that you are not abandoning just moving in stages and that you will complete the move on the 31st. If he gives you trouble, let him know that you will have a lawyer pursue an unlawful eviction case if he moves the other tennant in.
