Legal Question in Landlord & Tenant Law in Pennsylvania
My name is Paul Richards and I moved into Thorn Run Apartments on August 5, 2011 with my roommate, Stephen Decker. In order to attain the apartment my roommate and I required a co-signer. My mother, Michele Lekanka, co-signed for the apartment and agreed to do so for myself and Stephen. Towards the end of the month we added a third roommate, Alana Puskavich. Upon her move-in a new lease was created. Thorn Run Apartments never thoroughly finished the paperwork to receive Michele LeKanka’s permission to allow Alana Puskavich to be entered into the lease. I have documentation in which Michele LeKanka has not signed her authorization for Alana’s addition to the newer lease. Thorn Run Apartments was unable to produce the documentation requested that all signatures were accounted for. Upon request, I was threatened with Thorn Run Apartments’ “corporate attorneys,” who gave Stephen, Alana and I a deadline to vacate the apartment and will not allow Stephen and I to stay at the current address. During Alana's stay at the apartment she did not pay for any utilities but left her stuff in her room and continued to pay rent while her stuff occupied the room. Alana's Claim is that she doesn't have to pay Utilities because she does not stay there. Well our lease has been up since November 30, 2011. Alana never helped up clean up the apartment leaving all the work for Steve and I (Paul) to do. Well I received my Security Deposit back from Landmark Square and on that Paycheck Stub it had Steve and I's Contributions towards the security deposit with Alana name no where to be found, so I figured she didn't pay a security deposit, so Steve and I went to the bank and cashed it since both of our names where written on the check and split it evenly between the two of us. Well now I am getting threatening phone calls and emails ,as well as my mom, from Landmark saying that I need to give Alana her share of the rent or legal proceeding will take place which Rosemary Antol Nassan the Manager at Landmark said she would testify on Alana's behalf that she paid her security deposit.
Please I need help and some advise on what I should do?
