Racial Discrimintation

We have been living in 1 bed room apartment for about 4 yaers now.

we have a 19 month old baby now.When we moved in we had signed the lease of 2 adults and no children.

In april,2004 they send us the renewal form for renewing the lease for another year. In may 1 st, they demand us to move to 2 bedroom aprtment or terminate the lease at the end of the month .

They're point is 18+ months old babies need to move to 2 bedroom aprtment.

Fact:1. When we signed the lease, there was nothing about 18 month old babies. theer was just one point . 2 Adults -1 bedroom.

4 adults -2 bedoom.

2.we have been having problems with the neighbour staying upstairs.She has been complaining to aprt.office about my snoring and they couldn't help it.

So they 're just finding reasons to make us move.

We have been living in aaprt. community where some of them have babies and live in 1 bedroom.

They are'nt keen on the 18 month rule on everybody.

They are just enforcing on us because of Racial Discrimination.

3. Aren't they supossed to give atleast 2 months prior notice to the tenant for the move?

4. When we asked why the law is only enforced on us, teh property manager said..'' you don't teach me how to manage the complex''.

Your landlord may not want you to "teach" him how to run the complex, but apparently he wants to teach you how to be a parent.

It is illegal to force you to live in a particular apartment, or refuse to rent an apartment to you, because you have a child. It's discrimination based on "familial status."

You indicate also that they're discriminating against you because of race.

What notice is required? Whatever the lease provides for non-renewal by the landlord is the notice that is required unless it's unreasonably short (Less than a month is unreasonably short). In this case, they are basically evicting you from your apartment. Did you sign and return the renewal in April?

The landlord isn't "enforcing the law" on you--he's breaking several laws if what you're saying is correct. You could, if you wish, "teach him how to manage the complex" by filing complaints of discrimination against him as well as challenging your eviction.
