Legal Question in Landlord & Tenant Law in Pennsylvania

I Have No Rights to Back Yard?

My lease states ...''Lessor leases to Lesee the premises ... (typed in: Three bedroom brick house with full basement & attic) ... ''together with all appurtenances ..., etc.'' The house was advertised with a fenced backyard, but my landlady now tells me I have NO rights to the backyard. Is this true? I was expected to maintain it, which makes no sense to me.

Re: I Have No Rights to Back Yard?

You have two possible approaches. First if the backyard is not included in the lease the landlord fradulently induced you into the lease by advertising the property with a backyard. Second, if the lease includes the backyard the landlord is attempting to infringe upon your enjoyment of the leases premises. I suggest you contact an attorney to send a letter to the landlord. I offer free consultations.

In addition to what Attorney Johns said, if you were expected to maintain the yard, this is a fact which goes toward proving that the yard was intended to be included.
