Legal Question in Landlord & Tenant Law in Pennsylvania

Roommate refuses to pay rent.

Two of my friends and I leased an apartment for a year (June 1st, 2006- May 22th, 2007). One roommate has decided to move out on her own will and not refuses to pay rent for the rest of the agreement. All three of us signed and initialed one lease. I went and spoke with my landlord and was told that the roommate in question has to pay or at the end of the lease period my other roommate and I can take reciepts documenting that we paid the difference and take her to the District Magistrate. My question is whether my landlord should be responsible for getting the money from the roommate who left or should I take legal action against the roommate in question? The roommate who left also made it perfectly known that she doesn't care and won't pay so that my roommate and I living there now get evicted. Please help!

Re: Roommate refuses to pay rent.

Well I suspect the landlord has all three of your names on the eviction notice. As each person who signed the lease is responsible for seeing that the rent is paid.

That said if you wish to hold the roommate who moved out responsible you will have to make up her share of the rent and then sue her at District Magistrate. There will be some up front costs to file the suit but if you win the roommate you sued will have to pay that cost in addition to the rent she agreed to pay.

If you have any questions feel free to contact me. The initial consultation is free.
