Legal Question in Landlord & Tenant Law in Pennsylvania
My roommate had me sign a lease when I moved in, she made me believe it was her house. Recently found out she has been renting all along and has a different lease with her landlord. Now she has bought a house and is going to move out and leave me homeless. Right now I am having an MS attack and can't work, which means I don't have the money to move. What are my rights in this situation?
1 Answer from Attorneys
Your rights are to see a lawyer and sue this woman for fraud before your local District Office (small claims court). In small claims court the limits of any suit are $8,000. You can do this yourself, but your chances of success are greatly improved if you have a lawyer. If you have no money at all and cannot afford a lawyer, you might want to call the Erie County Bar Association and see if they can provide you with an attorney who can help you at nominal cost.
The advantage of proceeding in small claims court is that you will be given a hearing date quickly, sometimes in as few as 20 days. To determine what District Justice Office you should go to, consult the following web site and go to the one nearest to where yu are living. Hopefully you have a forwarding address for this roomamate:
