Legal Question in Landlord & Tenant Law in Pennsylvania

tenant rights

I have just discovered my landlord has not been paying the mortgage on the property I am renting from him, even though he collects the rent every month on the due date...he is charging me almost twice the amount of his mortgage payment....I have proof that he is in default on this mortgage...Act 91 letter sent to my address....what rights do I have if he forcloses on this property

Re: tenant rights

Sadly not many. If the property is foreclosed then the bank could evict you and probably will.

That said; assuming you have proof that you paid the rent in accordance to the lease you might be able to sue your landlord under the consumer protection law. If you were to prevail under the CPL you could ask for treble damages and attorney's fees. However, a win in court may leave you with a judgment that you might not be able to collect.

If I were you and get his side of the story and his plan for dealing with the problem.

If you have any questions feel free to contact me. The initial consultation is free.
