Verbal Rental Agreement Problem

I had a verbal agreement (no lease) for a man to rent a room in my house for 2 months. He gave me a check for the two months rent, and wrote ''2 months rent'' in the memo area of the check(lower left). This occurred 2 weeks before he moved in. A week later he called and told me he would only be there a month. Nothing was in writing. After the month he expected half of his money back. I did not agree and now he choses to sue me in small claims court. Whose side is the law on?
