Back Surgery
I had back surgery jan 2005.I had found out by the surgeon assitant that the surgeon tried something on me that has never been done to people who have had a plif surgery by trying to insert the rods that go thru the pins thru my BUTT cheek.I took a picture of it when I came home from the hospital.Everything I've read and watched videos on this surgery it is diffentant not done this way.Now I'm still having alot of pain in my back and legs.I said something to the surgeon about this and that his buddy told me what he did and he just blow me off.Could I have a malpractice suit?

Your description of inserting rods from below does not match what I can find on the internet regarding Posterior lumbar interbody fusion (PLIF) surgery. This may be a deviation from the standard of care, but it is not possible to tell without examination of the records and photographs, and consultation with an expert in the specialty.
More than fourteen months have passed since your injury. While Pennsylvania permits two years between the time you were injured and the time you have to file a lawsuit, there are considerable delays in investigation, etc. YOU can�t wait two years. An attorney taking this kind of case needs time to investigate.
