Birth Defect ??
My son was borne premature - his stomach ruptured due to a feeding tube - as parents his mother & I never persued the hospital for negligence - is there a statute of limitations??

The general answer is: it depends. The 'normal' statute of limitations for medical malpractice is two years, but there are certain cases in which it is extended. For example, the statute of limitations sometimes begins when the plaintiff first discovered the malpractice.

There is a statute of liimitations but its applications and llimits depend upon the facts. I the injuries resulted in death - 2 yrs, If the injuries did not result in death your child has until two years following his 18th birthday. You should conslult an attorney to determine whether the particular facts of your case justify and exceptions.
