Legal Question in Medical Malpractice in Pennsylvania

Out of court settelment

As a family we brought a case against a hospital for dropping my Mother while in the care of this hospital.

Today the case was settled out of court, however only my brother was given the amount. When asked, he said he wasn't allowed to give any other family member the said amount. His name alone is on the court doc. Our mother since has died.

My q.is, Is there any way I can find out this amount.

Thank you.

Re: Out of court settelment

My guess is that your brother is the duly appointed executor of your mother's estate. However, you should ask the attorney who handled the case exactly who was the plaintiff. If it is your brother as the executor, and if you are an heir to the estate, you certainly should be kept apprised of the amount of the settlement, and the amount which each heir will eventually receive. There is no legitimate reason for your brother to be secretive. Please contact me if need any other assistance.
