Dental Crown Improperly Fitted

i had a dental crown put on after a root canal that was very poorly done. 2 subsequent dentists recommended removing and replacing it. which we would be paying for out of pocket $1,200. i am told by the 2 above dentists that because it was poorly fitted, organic matter got into the tooth, and i could lose the tooth much earlier than normal. this would require an extraction and an implant. it is also possible that the tooth could last 10-20 years. i contacted the original dentist that did the poor job, and they offered a full refund of $600, they just the crown, another dentist did the root canal. however they required that i sign a waiver stating that I absolve them of any liability if i require future treatment. there were so quick to agree to a refund, it made me suspicious. should i take the refund or do i possibly have a case? or should i demand they pay my costs for the fixing of the crown which was $1,200 as I said in the beginning?

As far as your deciding whether you may have a malpractice claim, I advise you to call malpractice attorneys to get different opinions, as to whether there is a case that they would pursue.

Personally, I would not investigate our case. For an attorney to take this case, he would need convince a jury to award enough money, based on your damages, to justify the thousands (or tens of thousands of dollars) it takes to pursue a malpractice case. I don�t see the kind of damages from what you describe. Another attorney may feel differently, so I encourage you to call attorneys as early as possible, if you are interested in pursuing a possible claim.

As I am not intimately familiar with the facts of your case, I would not render an opinion regarding acceptance the offers you have.
