Legal Question in Medical Malpractice in Pennsylvania
Are elderly people worthless?
My mother, who was 85, was given 10x the amount of Procrit that she should have received. We weren't aware of this at first, but after 4 weeks this overdose ended up killing her. Upon speaking with several lawyers, I am told that that this case is not worth their time because we can only collect ''Lost wages from earning potential'' ''Unpaid medical bills'' and ''Pain and suffering''. Of course she was retired, had health insurance and Medicare. My question is this: Are doctors not punished when they make mistakes treating elderly patients. If not, what is the doctor's incentive to be more careful. It's possible he could do this to a younger patient. We'd like to prevent that, if possible. Is there another route other than a lawyer? Your help is appreciated.

The elderly are not worthless. There are some practical realities which make the processing of a claim of this type difficult. If however there is clear evidence that an overdose was given and that the overdose was the direct cause of death then something can and should be done.
