Legal Question in Medical Malpractice in Pennsylvania
Malpractice or Negligence?
6 yrs ago I had a tubal ligation and almost immediately experienced very bad menstrual cramps. The pain has become severe and incapacitating. My drs only treatment was anti-inflamatory meds, which provided very little relief. In Dec'01, she did send me for an ultrasound, which didnt show anything. Therefore, I have tolerated this pain, resulting in lost days of work. A few months ago, I consulted an endrocronogist and he couldn't believe the meds I was taking, with no relief. He sent me for an MRI, which didnt show anything. Then he did a laparoscopy, finding a tumor the size of a quarter, on my left tube. He also said he had never seen a tubal performed the way mine was. Also, let me add, my pain was on my left side and down my left leg. The biopsy results indicated the tumor was endometriosis. This is not curable and will cause problems for me in the future, but at least I have a diagnosis and my doctor can advise me what treatment options are available. My previous doctor took no steps to investigate the cause of my pain. When I complained about the pain I was suffering, her famous words always were, ''If it's treatable with medication.'' Do I have a case of negligence against my original gynecologist?
