Legal Question in Medical Malpractice in Pennsylvania

medical malpractice

I was in a auto accident. There was an incidental finding of a pancreatic mass. After seeking guidance from professionals it was decided that I would have a Distal paancreatectomy. (The mass could not be biopsied since it was deep in the pancreas.) Prior to surgery the anesthesiaogloist spoke with me offering me a procedureto help with after surgery pain. He said he could put medicine (morphine)in my spine that would keep me pain free for the first three days after surgery, much like an epidural when childbirthing. Sounded good to me, I accepted. Surgery went well. After surgery the nurse gave me an injection of morphine. For some reason, some of the morphine was released from my spine just when she gave me the morphine injection causing an overdose. They could not wake me up, All my stats dropped. They gave me a drip of narcan to counteract the drug. (The same drug they give to drug users who overdose)It worked and took all the morphine out of my system, But it also took away the pain relief. Instead of being pain free for 3 days, I had excrutating pain for 2 days until they could give me something to help with the pain. I needed breathing treatments because my lungs would not expand fully, was in ICU for 4 days. Do I have a case

Re: medical malpractice

You may or may not. What was the reason the Morphine was released from your spine? Was it something the MD knew or should have known about? You may want to look into that.
