Legal Question in Medical Malpractice in Pennsylvania
Medical malpractice?
My son was born 3 months prematurely and has been in the hospital almost 5 months now. We finally were nearing the end of this long journey when we received some disturbing news. A doctor called the other night and informed us that a nurse had dropped our son while bathing him. We were assured that he had not fallen on to the floor; that he had merely fallen in her lap and slid down her leg and was caught. We were told he had been thoroughly examined and was perfectly fine with no injury. 2 days later as his heart rate began to slow, they go in search for a possible cause. during this examination it is found that my son does indeed have a fractured skull and the story begins to change. please help this desperate mother with some knowledge of where i can take this from here

Re: Medical malpractice?
This is a preventable, negligently inflicted injury, assuming as expected that the skull fracture was caused by the fall. The question remains as to what are the present and future consequences or damages arising from this injury. Inquiry should be made as to whether the fracture resulted in any bleeding within or outside the brain, damage to surrounding brain tissue,or other complications. Records and/or imaging studies relating to the incident and subsequent treatment should be obtained. Consultation with a qualified and experienced med mal attorney is warranted.
