Legal Question in Medical Malpractice in Pennsylvania
medical malpractice
My son was born 6 years ago it was a nightmare the doc did every thing wrong he went into distress and they tried the vacuum on him when he was not in position and when they finally did a c section the cord was around his neck and they did CPR on him for 17 min and told us he was gone he then started breathing and was air lifted to another hospital he was in the NICU for 17 days and had bleeding on the brain from the vacuum enlarged heart and collapsed lung from the CPR and we were told he would have all kinds of problems he is doing well but is behind in some fine motor skills and has some trouble listening to the teacher I think I have post traumatic stress because every time he gets sick I go haywire which is not at all like me. Do I have a case?

Re: medical malpractice
Your individual claim for Post traumatic stress syndrome is very probably barred by the statute of limitations depending upon whether symptoms of the disorder should have led you to obtain a medical evaluation and legal assessment earlier.
Your son may have a potention claim depending upon facts you have not provided in your email. He benefits from an exception to the statute of limitations for claims involving minors
Re: medical malpractice
you may. I would need to see the records and talk with you in detail Where did this happen?
Re: medical malpractice
I am glad to hear that your son is doing well despite what happened at birth. The time to file your claim probably expired. You may still have a claim for your child. The records must be reviewed. Where did this happen?
