Legal Question in Medical Malpractice in Pennsylvania

Possible Medical Malpractice from surgery

I've had chronic pelvic pain for the past 2 yrs despite pain medication and all kinds of antibiotics, with no diagnosis. I've had 2 miscarriages in the past 4 months and recently had a tubal ligation. When I had the surgery the dr said he was going to look around to see what else was wrong. He found many adhesions that he removed. It's been almost 3 weeks from the surgery and I still have alot of pain and feel like I have a bladder infection. I feel like my bladder has been damaged. I work in a lab and have done a UA and culture and I do not have an infection. I went back to the dr because of still having this pain and he pretty much brushed it off saying that it's just my adhesions coming back (which I know don't come back that fast) and that theres nothing to do about them and I'll have to live with it for the rest of my life. I did have to sign a waver before the surgery stating that there was possible damages that could occur, along with a slight chance of future pregnancies. My question is, if they did damage something, would I have a case. And also I've been having pain for a long time and they never did anything, when they did the surgery they found the adhesions. They could have looked for that along time ago.

Re: Possible Medical Malpractice from surgery

You must first learn the cause of your current problems before considering whether a claim exists. The mere failure to cure does not provide proof of negligence. If your symptoms disappeared and then reappeared you have to consider the possibility that some new problem is responsible. Probably worth getting a second medical opinion which you should disccuss with your pcp.
