Legal Question in Medical Malpractice in Pennsylvania
I recently underwent what was to be a "routine" medical procedure (D&C). During the procedure, my uterus was punctured and bowel perforated. According to the surgeon who did the emergency repair and the gynecologist who did the D&C, my tissues/organs were "glued" together with adhesions from a TRAM procedure two years ago..."we don't ever want to see another abdomen like that again!"
My husband works at a medical college and all of his colleagues state unequivocally that I should sue. I am recuperating, but a uterine repair and bowel resection as well as lysis of adhesions is nothing simple from which to recover. It has put my job in jeopardy as I work in a cutthroat environment where there is someone looking to step into my shoes. Should I be considering a suit? I like and respect my gyn and trust that she did not do anything that should have resulted in this outcome. In reality, there was a uterine polyp...in removing the last of it, it was attached to the uterine wall, which was attached to the bowel, etc. She knew instantly that she needed to look at the tissue and when she did, knew there were repairs that needed to be made. 6.5 hrs later, it was over. Ultimately, I had peritonitis (routine with a bowel resection)...and ended up going home on IV therapy.
