Legal Question in Medical Malpractice in Pennsylvania

I had surgery in march 2010. I was told today that they made a mistake. they have me on the schedule to fix it tomorrow morning. i am scared that if i have the surgery i will not be able to go after this doc for malpractice and pain and suffering.
