Legal Question in Personal Injury in Pennsylvania

12 yr old hit my child in the eye with a crab apple

Hello,in August of 2005 my 2 sons asked me if they could go play with their friend Justin, who lives nearby, I said yes. Justin wasnt home, he was at his cousin's house which is also nearby. My two boys and their friend went to see if Justin wanted to come play with them in our complex. As they did so Justins cousins and their next door neighbor's son started throwing crab apples at my kids and their friend.(from their backyard) So my sons and their friends threw back and stopped and yelled for Justins cousins and the boy from next store to stop. Justins cousins stopped but the 11 -12 yr old kid from next door wouldnt stop,he said he pitches for Little League Baseball. Then one of his pitches popped my sons eye in. Major damage, surgery which was unsuccesful, major pain and suffering, weeks out of school, time out of work, medical bills, blindness, etc. I've tried to contct a few lawyers in my area but none wanted to take the case. They said I cant get any money from the child, had to prove it was accidental, had to prove parents were negligent. As my son lay on the grass in their backyard bleeding from his nose and eye,the father of Justins cousins picked my son up carried him to our home, not telling me it happened in his yard..
