I was in a accident with a commercial vehicle and I have limited tort insurance. Can I still sue?

You can always sue. However, if you are a limited tort insured (and you may not be, even though you think you are!), you won't be able to get compensated for your pain and suffering unless you fit within 1 of the exceptions to limited tort. some of the exceptions are:

The other vehicle was registered in a state other than PA

The other driver was charged and conviced or pleaded guilty to DUI.

You were a passenger in the commercial vehicle.

Otherwise it generally depends on the extent of your injuries and the amount and type of medical treatment you have undergone.
