Need An Attorney quick
My daughter was hit in the parking lot of a restaurant by a driver who lost control going over an iced bridge. She was ''T Boned, Police say it looks like it will be declared a total loss. She was released from ER with concusion, and bruises. Is on temp.medial leave. She has very little short term memory. Does not recall whether she has fed the animals or washed her hair within 5 minutes,or wheathe she received a phone call or made one. Needs to be reminded what day it is. Looses train of thought and needs conversation refreshed to continue. Book value on Toyota is $14000. and she owes $5000.00 above that. She has limited tort. Please advise what our options are. She is a drector of nursing.

Her selection of limit tort limits her ability to recover for pain and sufferring, unless she has suffered a "serious impairment of everyday life". This is dependent on a number of factors, including the treatment required, length of time restricted from work and everyday activities. I have handled a number of limited tort cases, and in fact have one in litigation now.
If she does not meet the lmited tort threshold, she is still entitled to recover for out of pocket medical expenses and wages loss. Please contact me to further discuss.

The topic for your question is the answer. You should consult counsel promptly. Sounds like the injury may be serious enough to get past the limited tort threshold. Many attorneys, including our firm, would be happy to meet with you and your daughter, with no obligation or charge.
The liability issues should be relatively easy, so you may want to consider the firm's experience with similar types of injuries, which can be difficult to prove because some of the symptoms are subtle.

I'm sorry your daughter has had such a difficult time after her accident. The prior replies gave you a quick summary.
