broken glass fell on me in restaurant

About a year ago I was in an Olive Garden restaurant in Philadelphia, PA. As the waiter cleared the table he overloaded the tray with plates and glasses. When he lifted it up to take it away he lost its balance and dropped the plates and glasses. Most of the glass fell in my hair and lap, while on the plates fell on my shoulder and hit the table and shattered onto me. The manager came over and filled out an incident report along with took care of the check. He asked it I was going to the hospital and I told him yes. When I left I decided not to go because I had no insurance. I have the business card and name of the store manager that took the report. I can no longer find my copy of the report but am in the process of contacting Liberty Mutual for a copy. This happened a year ago and I do not have any medical documentation even though I went through a week of migraines and stress from being scared from the sound of the plates dropping and being hit with broken glass. Do I have any form of a case or should I just leave it alone?

If you did not have any medical treatment it's not worth having an attorney pursue it. However, you may be able to negotiate a small settlement with the ins co. Try for $1500. They'll probably offer a few hundred, & try to negotiate to around $500 - $750. IN the end, you'll have to take whatever they eventually offer you. Don't be too anxious to settle.
