Legal Question in Personal Injury in Pennsylvania

car accident

passenger in car,hit by truck,the main question is I am 21 and was not driving not even in my car,I do not have car insurance, I spent 4 days in hospital with cuts on face and arms, bad concusion, do not remember a thing,broken blood vessel in brain, it has been 5 weeks and I just returned to work. The thing I need to know can or should I file a claim for lost wages and pain and suffering and if I should,what do u think a good settlmeet would be. I still am going to have tests done to see if my brain is healed up under doctors care yet. thank u

The Auto Law provides that if you do not own a car, you are covered by any auto insurance for any relative with whom you reside. If you do not reside with a relative who has auto insurance then you are covered by the auto insurance for the car in which you were a passenger. This means your medical bills will be paid by that auto insurer, up to the limits of the coverage. In Pa. the minimum medical coverage is $5000. If the ins. policy has lost wage coverage you are entitled to make a claim for your lost wages. Any other out-of-pocket medical expenses or lost wages are part of the claim you have against the driver(s) who caused the accident. You should consult with an experienced personal injury lawyer.
