Do I have a case against a bank?
I own and operate a corporation and I own the building its housed in separately.Great history but have fallen on difficult times.The bank is being too agressive and is about to declare a''payment default''against me for the building(two months late).The corp.also owes the same bank money on lines of credit and a term loan.We have been able to keep the payments current.The building is collateral for the loans and they all seem to be intertwined.If the bank forecloses, they will come out very well finacilly because I have some equity in the building and a lot of assets to liquidate in the corp.It seems to me that they are really jumping the gun to ''push'' us hard in order to get their money. Is their a conflict of interest for them? We are improving and have a great history but they are trying to ''push'' us towards liquidation. I also am trying to sell my corp.and have 4 interested buyers but the bank still wants to close us and all of my employees.I've shown very good faith and a few months ago I asked if we could get an interest only pymt. They said ''we will talk when you get current.''I got current within two weeks and then theytold me''too bad.''I have the potential to sell for over$1M or get us back on track and sell for over$3M.

I am not a corporate lawyer, but from what you describe, you should definitely consult with an attorney immediately. You may well have a case against the bank--I do not have the expertise to tell you--however a competenst commercial lawyer should be able to help you. Find one immediatley.
