Conflict of Interest

My husband and I used this attorney who was helping both us and our new neighbors obtain property. Husband filed divorce on his own in Jan. 2006 then let it lay, also in Jan.2006 we both got in a car accident this attorney's office handled it. Husbands settlement has been done since March of this year. I still have mine pending. In March of this year, I asked the attorney to check on the statis of the divorce, he did not when I called back a month later to check. Then in July, my husband called him to finish the divorce and has done so. I had to sign my rights away to the property we owned and I do not feel I can trust this attorney. Everytime I ask him to do something for me, he does not do it, until my now ex-husband calls him to ask him to do it.

Re: Conflict of Interest

The rules do not permit an attorney to represent parties that are adverse to each other.

There are exceptions to the general rule but they require a written waiver of the conflict and sometimes the conflict is not waivable.

If an attorney violates the rules he/she may not be entitled to their fee and may be subject to discipline.

You may want to locate another attorney to review the situation and advise you.
