Legal Question in Personal Injury in Pennsylvania

Daughter Injured at Quest Diagnostics

My daughter went to Quest Diagnostics for routine bloodwork a few weeks ago. She told the woman taking the blood she was whiting out but was told to stand up. She fainted and hit the wall hard enough to make a hole in it. She may have a scar from the injury. Quest has not offered to as much as pay for the ER (she went directly after the fall) or any doctor's bills and my daughter is now terrified to have blood drawn. Is there anything I can do? Thanks.

Re: Daughter Injured at Quest Diagnostics

Yes, it appears you have a case. It appears the reasonable standard of care would require that they make sure your daugher did not fall, by having her sit or putting her in a position to prevent injury. Also, please make sure she has sought medical attention for any potential head injury, including recurring headaches, etc. I would be happy to discuss this with you for a free consultation. It sounds quite possible that she would have a case if they knew she felt faint and told her to stand up anyway, taking the chance that she would faint. Plezse contact me if you wish to further discuss.
