employer had no workmens compensation insurance

if an employee of a pizza delivery place falls and breaks his back while delivering a pizza and the employer has no workers compensation insurance what are the legal recourses

See an attorney IMMEDIATELY because the employee has a very important decision. The company is obligated to pay workers comp benefits BUT if it was uninsured, the employee has an option to sue in negligence if the employer was at fault (say, if the fall was on the company premises and caused by a slippery floor).

Either way, you need legal advice to weigh the risks and benefits, and most likely the company will not pay voluntarily so you'll need to take legal action.

If someone other than the employer was at fault, you may have an option to sue them as well.
