Is ex-husband entitled to insurance proceeds of son killed in motorcycle acciden

My 29yo son was killed in a motorcycle accident, the other driver 100% at fault and facing homicide charges by vehicle. Sons father has been absent most of his life, provided very little financial support, will he be entitled to any insurance settlement?? I am administrator of estate, son had no wife or children.

My firm does lots of motorcycle work. Your question depends upon a number of things. The statute provides that certain people are entitled to take under the estate when no will exists. I would need more information toproperly give you an answer. In general, he may be entitled but there are circumstances which could prevent him form taking money.. A court will need to be invovled. Unfortunately, unless your son had a will, then his father and you would divide any settlement proceeds equally. While it might be possible to try to convince the court that the father abandoned his son and provided no support, that he should not be entitled to his share, this would be very difficult.
