It's not too late to make a claim. But the more important question is why you failed to see the ladder you tripped over. The law requires you to avoid obvious hazards. There are possible explanations for you failing to see the ladder, but I would have to speak with you and ask you some questions to see if I could find an acceptable excuse for your failure to see the ladder. Also, whether you pursue this may depend on how bad your back is. Please call to discuss.

I agree that you still have time to file a claim against the store. I also agree that there must be an adequate explanation as tro the failure to see the ladder especially if it was in plain view. You should certainly discuss the matter with an attorney. Your query did not indicate whether you have sought any medical treatment for the injury. It would certainly be prudent to get your pain checked out if it has not been done. If you would like to consult with me at my office about the matter do not hesitate to call.
