False Imprisonment?

What constitutes false imprisonment?

My uncle was falsely detained for allegely stealing for at least 3 hours. What happen was the product didn't caught the scanner. Nothing was concealed from the cashier. Could we make a case out of this?

Your facts are not sufficientlt clear. More information is needed. being held in a confined area without a means of leaving may constitute false imprisonment under certain facts. I would need to know much more concerning this matter.
