Legal Question in Personal Injury in Pennsylvania

Hit by Uninsured Motorist

I was in a auto accident on 10/13/01. The driver assured me that his auto insurance would cover damages. I was informed by my lawyer that this person's insurance lapsed on 9/27/01.

I did not carry uninsured or underinsured on my policy, an oversight I am paying for.

My daughter and I was both injured in the car accident and my car was totalled. What can I do to seek damages. I contacted several other law firms, that only go after companies.

What can I do? Also this man is still driving without insurance.

Re: Hit by Uninsured Motorist

You are learning a very hard lesson. Make sure for the future that you cover you and your family fully by immediately changing your auto policy to "full tort" and include uninsured motorist and underinsured motorist coverage. The only thing you can do for your past accident is file a lawsuit against the other driver, knowing that you probably will not collect any money, or very little. However, if you notify Penndot about an unpaid judgment relating to an auto accident, Penndot will refuse to renew his driver's license. You will probably have to pay an attorney to take the case to court. Unfortunately there's nothing else you can do.
