Ins. Co. refusal to pay lost wages b/c I refuse to sign waiver of liability

I was recently in a vehicle accident in which I was stopped and another car hit me. Her insurance company has paid damages to my car. I have limited tort and have asked to be compensated for my lost wages. I will not however, sign their ''waiver of liability'' due to the fact that my back was injured and I don't know if this could worsen or not. I just received a call from the insurance rep stating they WILL NOT pay my lost wages unless I sign this form. Is this allowed??

Unfortunately, the answer is yes. When a defendant's insurance company pays anything other than property damage, they customarily do it in one lump sum payment, and require the signing of a Release. Your wage loss is an item of damages that would be recoverable if you filed suit. If you or your physician believe that your back will worsen, or further disable you, you shouldn't sign anything. See a lawyer. Once you sign the Waiver of Liability, you won't be able to bring any further claim.
