The insurance company's decision obvioulsy depends on the facts of the case, as determined by the police report, if any, the statements of the participants and any witnesses, and the nature of the damages incurred to the vehicles. If the insurance company is in possession of actual facts that indicate that the accident was the other person's fault, the insurance company might be guilty of bad faith, which would require the company to pay your attorneys' fees as well as punitive damages.
