Living in Maryland, but, in an accident in Pennsylvania
I was a passanger in an atuo accident in PA. The driver of the other car, ran a red light and hit us. The driver of the car I was in has limited Tort. I have Maryland PIP $10,000 coverage. I sustained soft tissue damage and a buldging disc in my neck. I have about $5,000 in medical bills, but no lost wages, I was unemployeed at the time. Who will pay for my pain and suffering? If the PA insurance refuses, will my PIP pay? Can I collect damages from the driver of the car I was in, if the other man's insurance won't pay?

Your insurance company will pay your medical bills, under the PIP coverage of your own insurance policy. As an out-of-state resident you are not subject to to Pa. Law regarding limited tort. You are a "full tort" claimant. Your pain and suffering damages will be paid by the insurance company of the driver who was negligent, which seems to be the driver of the other car. You have a right to make a claim for a full recovery against the insurance policy of the negligent driver. Your own PIP coverage will pay your medical bills, but you can still use those bills as part of your claim (along with pain and suffering) against the Pa. driver. Your injuries are sufficiently serious that you will be seriously shortchanging yourself if you don't seek the assistance of an experienced personal injury attorney to negotiate with the insurance company and to see that all of your rights are protected. I have been dealing with insurance adjusters for 26 years and I know from experience that they will not take an unrepresented claimant seriously. I have had any number of people in your situation come to me with a miniscule offer from an insurance company, and have obtained considerably higher settlements for them in the final analysis.
