Legal Question in Personal Injury in Pennsylvania

Owner of a car crashed by unlicensed driver

My car's insurance expired on the 18 so i had it parked on the street. While I was at work my boyfriend with no license took my car with out my knowledge, and got into an automobile acident. He was found at fault. My insurance co denied me representation and I am now being told by the

other driver's insurance company tha t I have to reimburse them upwards of $20,000.00. What are my rights and what can I do to fight this? What can my boyfriend do?

Re: Owner of a car crashed by unlicensed driver

Since you were not the driver, nor did you provide permission for your friend to drive your car, you are not responsible. I'm sure the other driver's ins co knows this, but is just trying to get money from you. Tell the ins co you consulted with a lawyer, & were advised that it has no claim against you, but does have a claim against your friend. By the way, you also have a claim against your friend for the damages to your car.

The insurance company has no claim against you. Your boyfriend was not a "permissive user." You have a claim against him for the damages to your car, and the insurance company probably has a claim against him for damages.
