Rear-ended by a commercial vehicle
In 2001, my wife and two sons were rear-ended by a commercial vehicle while sitting still to make a left turn. We live in Virginia (NOT a no-fault state). We hired a PA attorney to handle the injury case. My issue is this: my wife continues to have problems with a ''soft-tissue'' injury to her lower back and hip. The injury prevents her from working full-time in her chosen profession. Her pain has not improved although ''aggressive'' treatments continue. As the two year limit approaches, we are forced to complete a demand statement. Must my family continue to lose income ( $20,000 annually) due to someone else's neglegence? The current demand statement would allow only the recovery of one year's lost income. We also do not know the value of future medical expenses. Is the burden of proof with us? I feel as if our case is being pressed into a template that is defined by the insurance industry. Our lives have changes dramatically due to this accident with no end in site!

You should be asking your PA. attorney these questions. If the response is unsatisfactory, then you must find another competent lawyer to deal with these issues in your behalf, which must be settled in Pennsylvania, if that's where the injury occurred.
