getting reimbursed from a hospital bill

My son was injured by another student in school. I had to take him to the Emergency Room for x-rays. I would like his parents to pay for my hospital deductible.

Can i make them pay for it

Parents are not responsible for the "bad acts" of their child, unless they knew or should have known the child had a propensity to act badly. So you probably cannot sue the parents, unless you can prove the above. However, the homeowner's ins for the parents may pay if the other child is found to be negligent (make sure you do not make a claim for an intentional act-ins will not pay for an intentional act). If the other child is under 7 he/she cannot be found negligent. If ages 7-14 it's presumed the other child cannot be negligent, but it's possible. If over 14 the other child can be found negligent. You should speak or write to the other parents & ask them to turn this in to their homeowner's ins co & try to deal with the ins co. If it's a small claim, like $500 or so, usually the ins co will pay if there's any validity to your claim. If not, you can sue in your local District Justice Court. Good luck!!
