Legal Question in Personal Injury in Pennsylvania

restitution money received by deceased person

My sister was assaulted in 1982 in PA. She moved to FL and died in 1984 unrelated to the assault. The person was caught, jailed and ordered to pay restitution. He is out of jail and paying the ordered money. I live in FL and I am receiving monthly checks from the court in PA in her name. I was executor of her estate and one of two people inheriting her estate. Am I or we entitled to this money? What do we need to do to collect it? How can the checks be cashed? The estate has been closed for almost 20 years. Thank you.

It must be determined under Penns. law whether the order to pay resititution was personal to your sister or is still to be paid to her estate. Call the court clerk to discuss. If it is payable to the estate you will have to go back to the Florida court to open the estate proceeding and obtain new checks as the personal fiduciary. Florida does not use the word executor.
