Legal Question in Personal Injury in Pennsylvania

who gets the setlement money

we hired an attorney to get a settlement for a motorcycle accident we were in. my wife was severely injured and i was not. we were on the motorcycle and were not at fault.their insurance company settled for the full coverage amount of $50,000. my hospitalization insurance put a lien on the settlement for $35,000 and my attorney fee is 33.3%. this leaves nothing for our expenses and my wifes pain and suffering. what can i do about this? my hospitalization is part of my benefit package and i pay into it. they are self insured! i pay a deductable, a co-pay and $25 dr. visits and part of the perscription cost. how can they take this money away from us when my wife so rightly deserves it. she is going to have lifelong problems from this accident. we don't think we have been represented fairly, yet our attorney says there nothing he can do about it.i tried getting advise from another attorney but they won't talk to me while i'm already represented. i don't know what to do! what happens if i don't sign the release forms? can my hospitalization go directly to the other insurance and still get all the money? how can i still get compensation for my wife?

They should be able to negotiate the medical bills' lien, if not already done. Also, I assume they explored whether your wife is entitled to underinsured benefits under your own policy before settling? Please contact if want to further discuss. I have multiple offices.
