signing off auto injury claim

We were involved in auto accident 11/7/99, other driver at fault. Our driver (russ)whiplash (i have fx hip). Car was totaled & other insurance paid for that. We are trying to get salary reimbursement for Russ, but they are 1st saying that Russ must completely sign off on everything, including future medical bills. Since they paid for the car already (without us signing off), why cant they send us the $318.00 for missed work? We dont want to sign off the medical in case whiplash exacerbates during next year. I have a lawyer for myself, but Russ does not as "limited tort". (Not happy w/ my lawyer anyway.) Is there a way we can get the salary paid without signing off?

You did not say who owned the car you were in, so it is not clear who the other insurance company paid. Regardless, the insurance company is trying to use the pressure of the $318 to get a general release from Russ. Can he afford to wait until he determines whether there is future medical? If he needs the money now, he may have to submit his PIP claim to his/your insurance company to avoid having to choose between waiting and signing a general release.

Incidentally, I assume your attorney correctly told you that he cannot handle Russ's claim because you, as a passenger, have to claim against him as well as the other driver.
