Legal Question in Personal Injury in Pennsylvania

Slip and Fall

My wife fell while shopping in a grocery store. In my rush to get her to an Emergency room I did not get a witness name. The store Mgmt. did get the name and they claim to have filed an accident report with HQ. The injury in fact was a broken hip and required surgery where do I go from here is the store liable?

Where you should go, is to consult an attorney. The store isn't liable just because someone was hurt -- it needs to be proven that the store was negligent, that they allowed some defect or dangerous condition which caused the injury.

Not a do-it-yourself project.

Whether the store is liable depends upon why your wife fell. I just finished up a case with WalMart where my client slipped on water that had spilled. WalMart accepted liability and we settled just before trial. Essentially, there must be a defect in the store or an improper condition that the store should have known about or protected against.

She should follow the hospital's advise for treatment and schedule to see your family doctor, if you have one. You should see an attorney, to determine whether you have a claim against the store, and if the attorney would place the store on notice of your claim.

you do not need a witness statement to prove your case. Any attorney worth anything will complete an investigation and look for witnesses. In addition,many of these facilities have camera. I have handle dozens of these these types of cases in both NJ and PA. Often the surveillance captures the incident. If I can help, give me a call.
