Legal Question in Personal Injury in Pennsylvania

My sons truck was stolenwhich ensued with a police chase. The person ended up wrecking the truck(totaled). Now my son has no transportation means. Can the person be lible for the cost of another vehicle?

The person who caused the damage can be held liable for the fair market value of the truck at the time of the incident, not the replacement value. He would also be responsible for the cost of a truck rental until your son was able to obtain a comparable vehicle. If your son used the truck in connection with a business, he may try to obtain damages from lost income as a result of the incident. I would also look at your son's insurance policy to determine if it provides any coverage for theft of the car. The best thing to do is to meet with lawyer to learn your son's options. If insurance won't pay, then you will almost definitely have to take this guy to court. Then, if you get a judgment against him, there may be problems on collecting the judgment, depending on his financial situation and his marital status. So before you spend a lot of money on getting a judgment, you need to know the liklihood of collectibility.
