Legal Question in Personal Injury in Pennsylvania
spousal duty in accident case
My fiance and I were involved in a car vs. motorcycle where he was the at fault party in the car because he made a left from a far lane into the path of the bike causing loss of control of the bike. The driver of the bike sustained an left arm injury (possibably broken requiring surgery). How much would I be liable for if he is brought to court for pain, suffering, and loss of wages after we are married at the end of the month? None of the large items are in his name (house, my car, utilities)

Re: spousal duty in accident case
You are not liable at all since you were not the driver of the car & did not cause the accident. If your fiance is covered by an auto insurance policy the insurance co will pay any amount owed up to the limits of coverage.

You definitely can recover even if your driver was at fault, so you should definitely contact our offices. This will be a complex case in terms of liability, and UM/UIM coverage. FEel free to call or e-mail me directly: [email protected].
